SUPCove Paddle Board Rental Waiver
PLEASE READ CAREFULLY BEFORE RENTING EQUIPMENT
THIS IS A LEGALLY BINDING AGREEMENT.
Paddle boarding, swimming and other water activities involve inherent risks, including the possibility of SERIOUS INJURY, PERMANENT DISABILITY, DROWNING AND DEATH.
BY SIGNING THIS AGREEMENT, YOU ASSUME THE RISKS ASSOCIATED WITH USING THE RENTED EQUIPMENT AND GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE SUPCOVE AND THE OTHER RELEASED PARTIES FOR CLAIMS ARISING FROM NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY LAW.
You are also accepting financial responsibility for SUPCove equipment while it is in your possession.
Do not sign this Agreement unless you have read and understood it.
1. The Parties
In this Agreement, “SUPCove” includes SUPCove, its owners, operators, employees, contractors, representatives, agents, affiliates, equipment suppliers and persons acting on its behalf.
Collectively, these parties are referred to as the “Released Parties.”
The person signing this Agreement is referred to as the “Renter.”
“Rental Equipment” includes any equipment supplied in connection with the rental, including:
- Inflatable paddle boards
- Paddles
- Fins
- Leashes
- Personal flotation devices
- Pumps
- Electric pumps
- Carrying bags
- Straps
- Dry bags
- Accessories
- Any other equipment supplied by SUPCove
2. Acknowledgement of Risk
I understand that paddle boarding and use of Rental Equipment involve inherent, obvious and unexpected risks, dangers and hazards.
These include, but are not limited to:
- Drowning
- Falling into the water
- Falling from a paddle board
- Inability to swim or remain afloat
- Deep water
- Sudden changes in water depth
- Cold water
- Hypothermia
- Heat exhaustion
- Sun exposure
- Dehydration
- Strong winds
- Waves
- Boat wakes
- Currents
- Sudden weather changes
- Lightning and storms
- Reduced visibility
- Rocks
- Logs
- Branches
- Underwater hazards
- Docks
- Buoys
- Boats
- Personal watercraft
- Other paddle boarders
- Swimmers
- Wildlife
- Slippery surfaces
- Falls while launching or landing
- Cuts
- Abrasions
- Sprains
- Fractures
- Head injuries
- Equipment malfunction
- Equipment failure
- Paddle breakage
- Fin damage
- Leash entanglement
- Personal flotation device failure or improper fit
- Deflation or puncture of a paddle board
- Collision with people or objects
- Collision with boats or other watercraft
- Becoming stranded or separated from shore
- Becoming separated from other participants
- Delayed rescue
- Delayed emergency response
- Errors in judgment
- Actions of other water users
- Actions or negligence of third parties
- Risks that are not presently known or reasonably foreseeable
- NEGLIGENCE OF THE RELEASED PARTIES
I understand that this list is not exhaustive.
3. Assumption of Risk
I FREELY AND VOLUNTARILY ACCEPT AND FULLY ASSUME ALL RISKS, DANGERS AND HAZARDS ASSOCIATED WITH USING THE RENTAL EQUIPMENT AND PARTICIPATING IN PADDLE BOARDING OR RELATED WATER ACTIVITIES.
I understand that these risks may result in:
PROPERTY DAMAGE, SERIOUS PERSONAL INJURY, PERMANENT DISABILITY OR DEATH.
I voluntarily choose to participate despite these risks.
4. Release and Waiver of Liability
In consideration for SUPCove permitting me to rent and use its equipment, I RELEASE, WAIVE AND FOREVER DISCHARGE THE RELEASED PARTIES from any and all claims, demands, actions, damages, losses, expenses and liabilities arising from or relating to my rental, possession or use of the Rental Equipment, TO THE FULLEST EXTENT PERMITTED BY LAW.
This release is intended to include claims arising from:
NEGLIGENCE OF THE RELEASED PARTIES, INCLUDING ANY ALLEGED FAILURE TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE RENTAL EQUIPMENT OR PADDLE BOARDING.
To the fullest extent permitted by law, this includes claims concerning:
- Selection of Rental Equipment
- Equipment inspection
- Equipment maintenance
- Equipment condition
- Equipment failure
- Safety information
- Instructions
- Launching or landing
- Recommendations concerning locations
- Weather or water information
- Emergency response
- Rescue attempts
- First aid
- Acts or omissions of SUPCove personnel
- Other alleged negligence of the Released Parties
5. No Supervision Included With Rental
I understand that a paddle board rental is not a lesson, guided tour, supervised activity or safety service.
Unless I have separately purchased a SUPCove lesson, tour or guided experience, I am responsible for determining:
- Where I paddle
- Whether conditions are appropriate
- Whether I possess sufficient ability
- When I enter the water
- When I return to shore
- How far I travel
- Whether weather conditions remain appropriate
- Whether I should discontinue paddling
SUPCove is not monitoring my location or supervising my activities during an equipment-only rental.
6. Weather & Water Conditions
I understand that weather and water conditions can change rapidly.
SUPCove cannot guarantee:
- Calm water
- Safe wind conditions
- Water depth
- Water temperature
- Water quality
- Absence of currents
- Absence of boat traffic
- Absence of underwater hazards
- Favourable weather
- Visibility
- Cellular service
- Immediate emergency assistance
I am responsible for checking current conditions and using reasonable judgment before and during my rental.
Receiving Rental Equipment from SUPCove does not constitute a representation or guarantee that conditions are safe.
If conditions exceed my ability, I will not enter the water or will return to shore.
7. Swimming Ability
I understand that falling into the water is a normal and foreseeable part of paddle boarding.
I will not misrepresent my swimming ability or the swimming ability of any participant for whom I am responsible.
I understand that a personal flotation device reduces certain risks but does not eliminate the possibility of drowning.
8. Personal Flotation Devices & Safety Equipment
I agree to comply with all applicable laws and regulations concerning personal flotation devices and required safety equipment.
I am responsible for ensuring that any PFD used by me or another participant is appropriate and properly fitted.
I will inspect supplied safety equipment before use and notify SUPCove immediately if I believe equipment is damaged or unsuitable.
9. Equipment Inspection
I acknowledge that I have had the opportunity to inspect the Rental Equipment before accepting it.
I agree to notify SUPCove of any visible damage, missing components or concerns before using the equipment.
Once the equipment has been accepted, I am responsible for protecting it from avoidable damage, theft and loss during the rental period.
10. Proper Use of Equipment
I agree to use Rental Equipment only for its intended recreational purpose and in a reasonable manner.
I will not:
- Intentionally damage equipment
- Drag paddle boards across pavement, rocks or other abrasive surfaces
- Use paddles to push against rocks or the bottom with excessive force
- Modify equipment
- Remove or alter safety components
- Use equipment while impaired
- Expose inflatable equipment to unreasonable heat
- Leave an inflated board unattended in extreme heat
- Exceed specified inflation pressure
- Tow equipment behind a motorized vessel
- Use equipment for unauthorized commercial purposes
- Use equipment in conditions clearly beyond my abilities
11. Responsibility for Rental Equipment
I ACCEPT FINANCIAL RESPONSIBILITY FOR THE RENTAL EQUIPMENT FROM THE TIME IT IS PROVIDED TO ME UNTIL IT IS RETURNED TO AND ACCEPTED BY SUPCOVE.
I am responsible for reasonable costs resulting from loss or damage beyond ordinary wear and tear where caused during my possession by misuse, negligence, loss, theft or failure to follow the rental instructions.
This may include damage to or loss of:
- Paddle boards
- Paddles
- Fins
- Leashes
- Pumps
- PFDs
- Bags
- Straps
- Accessories
Charges will reflect the reasonable repair or replacement cost of the affected equipment.
12. Lost or Stolen Equipment
I understand that I remain responsible for Rental Equipment that is lost or stolen while in my possession, except to the extent otherwise required by applicable law.
Theft does not automatically eliminate my responsibility to SUPCove for rented property entrusted to me.
If Rental Equipment is lost or stolen, I will notify SUPCove as soon as reasonably possible.
SUPCove may require a police report for stolen equipment.
13. Damage
I agree to notify SUPCove of any damage that occurs during my rental.
I will not intentionally conceal damage.
Examples of chargeable damage may include:
- Major punctures
- Cuts
- Tears
- Seam damage caused by impact or misuse
- Broken paddles caused by misuse
- Broken or missing fins
- Lost equipment
- Heat damage
- Damage caused by improper inflation
- Damage caused by dragging
- Damage caused by vehicles
- Damage caused by improper transportation
- Damage caused by pets
- Damage resulting from intentional or reckless misuse
Normal wear and tear from reasonable recreational use will not result in a damage charge.
14. Equipment Failure
If equipment appears damaged or begins malfunctioning during the rental, I will stop using it where reasonably possible and contact SUPCove.
I will not continue using equipment where doing so would obviously create an unreasonable risk of injury or further damage.
15. Transportation of Rental Equipment
If I transport Rental Equipment myself, I am responsible for securing and transporting it appropriately.
SUPCove is not responsible for damage to my:
- Vehicle
- Roof rack
- Interior
- Exterior
- Trailer
- Other personal property
arising from my loading, unloading, securing or transportation of Rental Equipment, except to the extent liability cannot legally be excluded.
I am responsible for ensuring that equipment is legally and safely secured before driving.
16. Vehicles & Unattended Equipment
I will not leave Rental Equipment unsecured where it can reasonably be stolen, blown away or damaged.
I understand that extreme heat inside vehicles can damage inflatable paddle boards and other equipment.
I will not leave Rental Equipment in conditions that could reasonably cause heat damage.
17. Third-Party Use
I WILL NOT ALLOW AN UNAUTHORIZED PERSON TO USE SUPCOVE RENTAL EQUIPMENT.
Each adult participant who will independently use Rental Equipment may be required to complete SUPCove's applicable waiver before use.
I will not knowingly provide SUPCove equipment to a person who:
- Has not been authorized to use it
- Is visibly impaired
- Cannot safely operate it
- Refuses required safety equipment
- Is using the equipment in an obviously dangerous manner
18. Children & Minors
I understand that minors require appropriate supervision.
A parent, legal guardian or responsible supervising adult is responsible for ensuring a minor uses properly fitted safety equipment and follows applicable instructions.
Any required parent or guardian documentation must be completed before a minor uses SUPCove Rental Equipment.
19. Alcohol, Cannabis & Drugs
Rental Equipment must not be operated while impaired.
I agree not to use SUPCove Rental Equipment while my judgment, balance, coordination or ability is impaired by alcohol, cannabis, illegal drugs, medication or another substance.
20. No Guarantee of Rescue
I understand that an equipment rental does not include continuous monitoring or rescue services.
SUPCove may not know my location once I leave the pickup or launch area.
I am responsible for making reasonable decisions concerning distance from shore, weather, ability and conditions.
Emergency response may be delayed or unavailable.
21. Rescue & Recovery Costs
If emergency services, search and rescue organizations, towing providers or other third parties impose lawful charges relating to an incident involving me or the Rental Equipment, I understand that responsibility for those charges will be determined according to applicable law and the circumstances of the incident.
22. Late Returns
I agree to return all Rental Equipment by the agreed return date and time.
Late returns may interfere with another customer's reservation.
SUPCove may charge applicable late fees disclosed as part of the rental terms.
Continued possession of equipment beyond the rental period does not transfer ownership of that equipment to me.
If I cannot return equipment on time, I will contact SUPCove as soon as possible.
23. Failure to Return Equipment
Rental Equipment remains the property of SUPCove at all times.
I agree to return all equipment at the end of my rental period.
Failure to return equipment may result in additional rental charges, reasonable replacement charges or other remedies available to SUPCove under applicable law.
24. Personal Property
I am responsible for my personal belongings.
To the fullest extent permitted by law, SUPCove is not responsible for phones, wallets, keys, cameras, jewellery, clothing or other personal belongings that are:
- Lost
- Stolen
- Damaged
- Submerged
- Dropped into the water
Dry bags, waterproof cases and similar products do not guarantee that their contents will remain dry.
25. Indemnity
To the fullest extent permitted by applicable law, I agree to indemnify and hold harmless the Released Parties from claims, losses, damages, liabilities or reasonable costs arising from:
- My intentional misconduct
- My reckless conduct
- My misuse of Rental Equipment
- My violation of safety instructions
- My unauthorized provision of Rental Equipment to another person
- Property damage or injury I cause to another person through my wrongful conduct
- Damage I intentionally or negligently cause to SUPCove equipment
Nothing in this section requires indemnification where prohibited by applicable law.
26. Medical Emergencies
If SUPCove personnel are present during a medical emergency and I am unable to communicate, I authorize them to contact emergency services and provide reasonable assistance.
I understand SUPCove personnel may not be medical professionals.
I am responsible for ambulance, hospital, medical, evacuation or similar expenses incurred on my behalf except where applicable law provides otherwise.
27. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable laws of Canada.
Subject to rights that cannot legally be restricted, disputes relating to this Agreement or the rental shall be brought in British Columbia.
28. Severability
If any portion of this Agreement is found to be invalid or unenforceable, that provision shall be severed or limited only to the extent necessary.
The remaining provisions will continue to apply to the fullest extent permitted by law.
29. Entire Agreement
I acknowledge that this Agreement contains the terms concerning assumption of risk, release of liability and responsibility for Rental Equipment.
No verbal statement made by SUPCove personnel modifies this Agreement unless confirmed in writing by an authorized representative of SUPCove.
30. Acknowledgement
BY SIGNING BELOW, I CONFIRM THAT:
- I have read this Agreement in full.
- I understand its terms.
- I understand paddle boarding involves inherent risks.
- I understand serious injury, drowning and death are possible.
- I voluntarily assume the risks associated with using the Rental Equipment.
- I understand an equipment rental does not include supervision or continuous monitoring.
- I accept responsibility for Rental Equipment while it is in my possession.
- I agree to follow applicable safety requirements and laws.
- I will not operate Rental Equipment while impaired.
- I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES FOR CLAIMS ARISING FROM NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY LAW.
- I have had the opportunity to ask questions.
- I am signing voluntarily.
- I intend to be legally bound by this Agreement.
